Terms of Sale

Rules for purchasing Weizo software: purchase methods, prices, subscriptions, activation codes, withdrawal from the contract and complaints. The rules for using the software are set out in the separate Licence Terms.

§ 1Who sells and what these terms cover

The seller is Łukasz Chróśniak, carrying on business under the name Firma „Łukasz Chróśniak”, ul. 16 Pułku Ułanów Wlkp. 5, 85-319 Bydgoszcz, Poland, Tax ID (NIP) 9671175702, contact address support@weizo.eu, website weizo.eu (the “Producer”).

These terms apply to the sale of all of the Producer’s Products: modules for PrestaShop and the apps associated with them.

§ 2Definitions

ProductThe Producer’s software: a module installed in a PrestaShop shop, together with the associated app, if the Producer makes one available.
CustomerA party that acquires a Licence.
ShopA single PrestaShop installation of the Customer, identified by the Product by means of a unique technical identifier and a domain.
LicenceThe right to use the Product in one Shop for a specified period, on the terms described in the Licence Terms.
SubscriptionA purchase that renews automatically for successive periods until cancelled.
One-time PurchaseA purchase for a fixed period that does not renew.
Activation CodeA string of characters with which the Customer activates a Licence.
BundleA separate product covering more than one of the Producer’s Products; its scope is described in the Licence Terms.

§ 3How a purchase is made

  1. A Licence is purchased in the Product’s configuration panel, in the Customer’s shop. The Product presents the offer and redirects to payment with the payment provider.
  2. A Licence may also be acquired in the form of an Activation Code — from the Producer or from another seller who distributes it (§ 7).
  3. The contract is concluded when the payment is booked, and in the case of an Activation Code — when the code is purchased from the relevant seller.
  4. When purchasing in the Product panel, the Customer accepts these Terms of Sale and the Licence Terms in the version in force at the time of purchase. The acceptance is recorded together with the version identifier of the documents.
  5. The Producer does not sell on the weizo.eu website; the website is for information purposes only.

§ 4Prices, payments and invoices

  1. Prices are stated as net amounts; tax is added to the amount payable in accordance with the applicable law. The applicable price is the price shown at the time of purchase.
  2. The available Licence periods and purchase methods are those stated in the offer presented at the time of purchase.
  3. Payments are handled by an external payment provider. The Producer does not receive or store payment card details.
  4. The Producer issues an invoice for each purchase and sends it by e-mail to the address provided at the time of purchase.

§ 5Subscription and cancellation

  1. A Subscription renews automatically for a further period until cancelled.
  2. A Subscription can be cancelled by the Customer on their own, at any time, in the payment provider’s customer portal. Cancellation takes effect at the end of the paid period — the paid period is neither shortened nor refunded pro rata.
  3. A failed renewal payment means that the next period has not been paid for; the consequences for access to the Product are described in the Licence Terms.
  4. A One-time Purchase does not renew. To use the Product after the period ends, a Licence must be acquired again.

§ 6Price changes

  1. The price of a paid period is fixed. A change to the price list does not affect the current billing period.
  2. The Producer may change the price of a Subscription with effect from the next billing period by notifying the Customer by e-mail at least 30 days in advance of the renewal date. The notice states the current price, the new price and the date from which the new price applies.
  3. A Customer who does not accept the new price may cancel the Subscription by the renewal date — on their own, in the customer portal. Cancellation does not shorten the paid period.
  4. Failure to cancel by the renewal date constitutes acceptance of the new price.
  5. A price change does not apply to One-time Purchases already made.

§ 7Activation codes

  1. An Activation Code may be distributed by the Producer or by another seller.
  2. The Licence period runs from the date on which the code is activated in the Shop, not from the date on which it was acquired.
  3. The code must be activated within 24 months of purchase.
  4. A code becomes tied to one Shop on first use and cannot be used in a second Shop. If, at the time of activation, the Shop holds a valid Licence, the period of the code is added to the end of that Licence — paid days are not lost.
  5. Complaints and returns concerning the purchase of the code itself are handled by the seller from whom the code was acquired, on the terms applicable at that seller. The Producer is responsible for the operation of the Product and the Licence on the terms described in these Terms of Sale and in the Licence Terms.

§ 8Withdrawal from the contract

  1. The Licence is digital content supplied immediately after the contract is concluded.
  2. A consumer, and a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for that person, has the right to withdraw from the contract within 14 days. This right expires if that person has consented to the start of performance before the end of that period and has acknowledged the loss of the right of withdrawal — this consent is obtained at the time of purchase.
  3. If a trial period is provided for the Product, the Product can be tried before purchase without providing payment details; the rules are set out in the Licence Terms.
  4. Other Customers do not have a right of withdrawal.

§ 9Complaints

  1. Complaints are accepted by e-mail at support@weizo.eu. A response is given within 14 days.
  2. It is advisable to include in the complaint the shop address, the Product version and a description of the problem — this shortens the time needed to process it.

§ 10Personal data

The rules for processing data are set out in a separate document: Privacy Policy.

§ 11Changes to these terms

  1. Each version of these Terms of Sale is published at its own permanent address and marked with a version number and date. Earlier versions remain available.
  2. A concluded contract is governed by the version accepted at the time of purchase. A change to these Terms of Sale binds the Customer from the next billing period and after notice given at least 30 days in advance; § 6(3) and (4) apply accordingly.
  3. Changes resulting solely from changes in the law or from obvious clerical errors do not require the notice period referred to in paragraph 2.

§ 12Governing law and jurisdiction

  1. The contract is governed by Polish law. This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
  2. Disputes with Customers who are not consumers are resolved by the court having jurisdiction over the Producer’s registered place of business.
